What Important Historical Problems Led to the Creation of the Policy?
Substance abuse has been a worldwide problem at all levels of society since the beginning of time. Attention has been made toward the use of legal and illegal substance by pregnant women over the past several decades. Almost all drugs are known to cross the placenta and have some effect on the fetus. According to the American Academy of Pediatrics (2013) the first studies of the effect of substances consumed by a pregnant women to the developing fetus were identified in the 1960’s of prenatal tobacco use. These studies opened the door to further research and studies. The effects of Alcohol and opiate use have been studied since the 1970’s (Jones, Smith, 1973) and the effects of a variety of other drugs have been studied since 1979 and early 1980’s (Flinnegan, 1979).
Prenatal substance abuse continues to be a significant problem in the country and poses important health risks for the developing fetus. Beginning in the early 1980’s, states began to enact legislation in response to the increasingly …show more content…

This issue has plagued state lawmakers since the late 1980’s and many remain at odds over how to approach the problem. Some states have attempted to criminalize prenatal drug use or treat it as grounds for terminating parental rights, while others have placed a priority on making drug treatment more readily available to pregnant women. The issue shows the difficulty policymakers face in attempting to balance the autonomy and bodily integrity of pregnant women with society’s interest in ensuring the birth of healthy children.
